How can someone reconcile the desire to eat meat, and a tendency toward vegetarian ideals? How should we reconcile contradictory moral values? How can we aggregate different moral theories? How individual preferences can be fairly aggregated to represent a will, norm, or social decision? Conflict resolution and preference aggregation are tasks that intrigue philosophers, economists, sociologists, decision theorists, and many other scholars, being a rich interdisciplinary area for research. When trying to solve questions about moral uncertainty a meta understanding of (...) the concept of normativity can help us to develop strategies to deal with norms themselves. 2nd-order normativity, or norms about norms, is a hierarchical way to think about how to combine many different normative structures and preferences into a single coherent decision. That is what metanormativity is all about, a way to answer: what should we do when we don’t know what to do? In this study, we will review a decision-making strategy dealing with moral uncertainty, Maximization of Expected Choice-Worthiness. This strategy, proposed by William MacAskill, allows for the aggregation and inter-theoretical comparison of different normative structures, cardinal theories, and ordinal theories. In this study, we will exemplify the metanormative methods proposed by MacAskill, using has an example, a series of vegetarian dilemmas. Given the similarity to this metanormative strategy to expected utility theory, we will also show that it is possible to integrate both models to address decision-making problems in situations of empirical and moral uncertainty. We believe that this kind of ethical-mathematical formalism can be useful to help develop strategies to better aggregate moral preferences and solve conflicts. (shrink)

Information can be public among a group. Whether or not information is public matters, for example, for accounts of interdependent rational choice, of communication, and of joint intention. A standard analysis of public information identifies it with (some variant of) common belief. The latter notion is stipulatively defined as an infinite conjunction: for p to be commonly believed is for it to believed by all members of a group, for all members to believe that all members believe it, and so (...) forth. This analysis is often presupposed without much argument in philosophy. Theoretical entrenchment or intuitions about cases might give some traction on the question, but give little insight about why the identification holds, if it does. The strategy of this paper is to characterize a practical-normative role for information being public, and show that the only things that play that role are (variants of) common belief as stipulatively characterized. In more detail: a functional role for “taking a proposition for granted” in non-isolated decision making is characterized. I then present some minimal conditions under which such an attitude is correctly held. The key assumption links this attitude to beliefs about what is public. From minimal a priori principles, we can argue that a proposition being public among a group entails common commitment to believe among that group. Later sections explore partial converses to this result, the factivity of publicity and publicity from the perspective of outsiders to the group, and objections to the aprioricity of the result deriving from a posteriori existential presuppositions. Drawing on a passage from Ramsey's Truth and Probability, we formulate a simple, plausible constraint on evaluating the accuracy of credences: the Calibration Test. We show that any additive, continuous accuracy measure that passes the Calibration Test will be strictly proper. Strictly proper accuracy measures are known to support the touchstone results of accuracy-first epistemology, for example vindications of probabilism and conditionalization. We show that our use of Calibration is an improvement on previous such appeals by showing how it answers (...) or sidesteps problems that have been raised for previous work in this area. (shrink)

Albert and Cederman couch the neorealist perspective in terms of ‘systems’ theorizing, Ferguson and Mansbach rhetorically discuss issues and non-issues which are readily addressed within the neoliberal perspective, and of course, Onuf is unabashedly a constructivist. Below, I discuss each theoretical perspective relative to the articles assigned, and, thereafter conclude with some observations on the three articles and theoretical frameworks.

It is difficult for prioritarians to explain the degree to which justice requires redress for misfortune in a way that avoids imposing unreasonably high costs on more advantaged individuals whilst also economising on intuitionist appeals to judgment. An appeal to hypothetical insurance may be able to solve the problems of cost and judgment more successfully, and can also be defended from critics who claim that resource egalitarianism is best understood to favour the ex post elimination of envy over individual endowments.u.

After nearly 76 years following the UN Charter, the dominant feature of the multilateral international order has shifted from a focus on states’ sovereignty to the rights of the individual. It is now widely accepted that human rights are not the province of any one state’s domestic affairs, but of importance to the entire international community. The UN Security Council sits atop the supra-state order, and holds the ultimate authority to initiate consensus-based, collective action so as to limit or prevent (...) gross human rights violations. Yet, many times the Security Council is slow to act, and consensus is exceedingly rare. This begs the question: in the face of gross human rights violations and Security Council inaction, is unilateral humanitarian intervention justified? The present state of international law on the matter is unsettled and controversial to many. What follows is a discussion on the development of international law relating to unilateral humanitarian intervention, the permissibility of intervention for gross human rights violations, and justification for intervention under existing international law. I conclude that under the present multilateral regime, unilateral humanitarian intervention is legally justified, despite fears that the principle may be invoked for the purposes of cloaking acts of aggression. Does it seem that with each reported state cyberattack, there comes an announcement of discovery, an attribution to one of a handful of usual suspects, some threatening language suggesting imminent retribution, and then nothing more? Increased incidence of cyberattack makes its occurrence seem simultaneously rampant in terms of publicity and minimal in terms of threat of war. If rampant, how can repeated deployment by the same actors carry no punitive consequences? How is such audaciousness tolerated? For some, a cyberattack by (...) a state is an act of war. Its prevalence suggests there must be a void somewhere that facilitates its use without consequence. Others think state cyberattack is like other internet novelties: digital malfeasance, amounting to a nuisance that naturally follows from a digital‐based existence, particularly since non‐state actors are typically involved. Yet, state‐on‐state hostilities are historically perilous on a vast scale, and there is a multilateral system for regulating the use of force in the context of war. Acts of war, even when seeming minimal in impact, are not by‐products of a digital fad, and cyberattack is now described as far more than ‘nuisance’. If anywhere, the place for clarity on hostile state cyberoperations use should be accounted for in International Humanitarian Law. Yet, in its present form, it is ambiguous if not silent on the subject, suggesting that cyberattack currently presents an advantage to perpetrating states. Does this void or these ambiguities make cyberattacks more legally advantageous to states than traditional, kinetic weaponry? I examine whether existing IHL is sufficiently adaptable to state cyberoperations through a mixed legal and theoretical approach and conclude that they do. (shrink)

Are interpersonal comparisons of desire possible? Can we give an account of how facts about desires are grounded, that underpins such comparisons? This paper supposes the answer to the first question is yes, and provides an account of the nature of desire that explains how this is so. The account is a modification of the interpretationist metaphysics of representation that the author has recently been developing. The modification is to allow phenomenological affective valence into the “base facts” on which correct (...) interpretation is grounded. To use this extra resource within that theory to vindicate interpersonal comparisons, we will need to appeal rational connections between level of valence and level of desire, which this paper sets out and examines. For the purposes of this enquiry—an account of what Equiano’sa modernity was, and which particular historical ‘demarcations’ of modernity provided for an enslaved man to achieve freedom through great fortune and great cunning, I will assume a definition of ‘modernity’ as defined by Kathleen Wilson: “. . . not one moment or age, but a set of relations that are constantly being made and unmade, contested and reconfigured, that nonetheless produce among their contemporaneous witnesses the conviction of historical difference.” By (...) adopting this definition, modernity in the times of Equiano refers to, “the cultural practices and representations that produced certain kinds of subjects and objects of knowledge, upheld widely-shared notions of space and time, or facilitated the formation of cultural identities that resulted in pluralities and contradictions as well as unities and coherences,” which provided for a slave to acquire freedom amidst eighteenth-century imperialism, slave-trade, and emerging abolitionist sentiments within bourgeois culture. For Rousseau, humankind is in a perpetual state of decay—decadency from an earlier, natural, primitive, and perfect state. For Rousseau, the natural man, or man in the state of beast, was of an era where humankind was unencumbered by that which is now entirely associated with society—that is, “. . . establishment of laws and of the right of property . . . the institution of magistracy . . . and the conversion of legitimate into arbitrary power.” For Kant, humankind (...) is in its natural state. For Kant, nature brings about conditions that continually develop and refine humankind’s dispositions, purposefully setting about societies in order to facilitate a foundation within all civilized society, whereby all of humankind’s goals may be achieved. All matters have their place—placed there by nature, as though with purpose. For Kant, nature intended for humankind to employ reason, to acquiesce to coercion for social cohesion, and to strive to build a society that is ever-increasingly progressing towards perfection. Nature uses humankind’s dispositions, including ‘antagonistic’ behavior to gradually bring about a, “perfectly just civil constitution.” Humankind’s highest goal yet to be achieved is for that just civil constitution to emerge from trial and error (in the form of wars, revolutions, secessions, abdications), over time, ultimately providing for development of other dispositions within a perfect society. Kant's formulae ought to effectively produce the same result when applied to the moral validity of any particular maxim; further, no valid maxim produces contradictory results when applied against Kant's Universal Law and Humanity formulae. Where one uses all formulae in the assessment of a maxim, one gains a more complete understanding of the moral law, thereby bridging principles of reason with intuition within the agent who has undertaken to evaluate the morality of a particular action. These formulae command without (...) regard to any particular interests, but are instead unconditional; further, these formulae effectively limit choice of action and therefore give rise to duty. Kant implies that the structure of all maxims requires different formulae of the same moral law, i.e., all maxims have a ‘form’ and a ‘matter’, which prompt reconfiguring of the categorical imperative into different formulae in order to test the morality of a maxim. Under the UDHR, all persons have the right to "seek and to enjoy . . . asylum from persecution." From this designation as fundamental followed codification of the right in the 1951 Convention relating to the Status of Refugees and the 1967 Protocol Relating (collectively 'the Convention'), the "centrepiece" of treaties and customary norms that make up international refugee law. It defines and regulates the status and rights of refugees; its purpose is to safeguard the basic rights of persons "outside (...) their country of origin," who have fled due to a legitimate fear of persecution. Fundamentally, it guarantees that asylees and refugees enjoy rights without discrimination; without penalization for illegal territorial entry; and, without expulsion or return to "territories where . . . life or freedom would be threatened on account of . . . race, religion, nationality, membership of a particular social group or political opinion," —or 'non-refoulement'. What follows is background on development of the principle of non-refoulement, evasive US Asylum Cooperative Agreements ('ACAs') and implementing legislation, and the resulting erosion to the right to asylum. Justiciability sets the boundaries of judicial review and the rule of law. A justiciable issue is that which is appropriate within a judicial forum. That is, where an "independent and impartial body" can remedy rights violations of identifiable claimants, the issue before it is justiciable. If it falls beyond what is judicially determinable, it is 'non-justiciable'. The principle is not fixed, as it does not permanently set the boundaries of that which is appropriate for judicial determination. Rather, it evolves "from (...) context to context," and expands and narrows along what falls within judicial competencies at a particular time. On an elementary level, it is distinct from jurisdiction, as it establishes boundaries of subject matter on policy or constitutional grounds, whereas jurisdiction is grounded in established legal rules. However, questions of jurisdiction can be subsumed under broader questions of justiciability. (shrink)

The local opposes the global or the macro opposes the micro and vice versa, respectively. This dialectical relationship further exposes that scales are socially and politically constructed, representative of a phenomena that is relational, and is thus of important consideration in analysis beyond simple labeling. That is, scale represents more than ‘size’ and ‘complexity’, but also reveals the relational. It is the relational—the relationship between the ‘global’ and its contents or the ‘local’—which provides for or is wont for analytic complexity (...) and theorizing. (shrink)

A phronetic approach takes into account everything possible. By this, the phronetic researcher ought to be better-informed of the practical—that which is readily available in order to solve localized political problems and to direct political participants to think in terms of value-rational understanding and action. Phronetic knowledge ought to be of utility to the citizenry—and not only to academia. It does not only explain phenomena, but also provides for altering the outcomes associated with political phenomena by integrating value judgments and (...) broader ethical precepts into the analysis. This is instrumental in producing knowledge that provides for practical application of problem solving that can be deemed good or better, and provides a means for ascertaining the bad or worse in a given political scenario. This paper examines how knowledge is produced by the phronetic approach, what knowledge can be known by the phronetic approach, and whether there are inherent limitations to the phronetic approach to understanding. Awarding rights to rivers, forests, and other environmental entities (EEs) is a new and increasingly popular approach to environmental protection. The distinctive feature of such rights of nature (RoN) legislation is that direct duties are owed to the EEs. This paper presents a novel rebuttal of the strongest argument against RoN: the no interest argument. The crux of this argument is that because EEs are not sentient, they cannot possess the kinds of interests necessary to ground direct duties. Therefore, they (...) cannot be legitimate rights-bearers. After considering and rejecting standard responses to this argument, the paper challenges its fundamental assumption: that rights-correlative duties must be grounded in the interests of the rights-bearer. The paper then presents the RoN critic with a dilemma. The critic must either accept that EEs are legitimate rights-bearers, or delegitimise many well-established rights-bearers along with EEs. Either way, the no interest argument loses its force. (shrink)

In the Critique of Judgment, Kant claims that genius is a talent for art, but not for science. Despite his restriction of genius to the domain of fine art, several recent interpreters have suggested that genius has a role to play in Kant’s account of cognition in general and scientific practice in particular. In this paper, I explore Kant’s reasons for excluding genius from science as well as the reasons that one might nevertheless be tempted to think that his account (...) allows room for the scientific genius. I then argue that Kant’s concerns are not only epistemic, but also moral, and together, they give us good reason for resisting the veneration of genius. (shrink)

We develop and apply a multi-dimensional conception of explanatory depth towards a comparative analysis of inflationary and bouncing paradigms in primordial cosmology. Our analysis builds on earlier work due to Azhar and Loeb (2021) that establishes initial condition fine-tuning as a dimension of explanatory depth relevant to debates in contemporary cosmology. We propose dynamical fine-tuning and autonomy as two further dimensions of depth in the context of problems with instability and trans-Planckian modes that afflict bouncing and inflationary approaches respectively. In (...) the context of the latter issue, we argue that the recently formulated trans-Planckian censorship conjecture leads to a trade-off for inflationary models between dynamical fine-tuning and autonomy. We conclude with the suggestion that explanatory preference with regard to the different dimensions of depth is best understood in terms of differing attitudes towards heuristics for future model building. If the world itself is metaphysically indeterminate in a specified respect, what follows? In this paper, we develop a theory of metaphysical indeterminacy answering this question.

Many will readily acknowledge there being rights of humans which trump the rights of states. Thus, these rights are aptly labeled ‘Human Rights,’ by which we may measure and admonish state-conduct. However, in contemporary Human Rights discourse, there is an emerging strand of thought in the academy that is Anti-Human Rights. To understand the foundations of Anti-Human Rights discourse, and to address the arguments that have been put forth, I analyze and incorporate the works of John O. Nelson, Raymond Geuss, (...) Wendy Brown, and Slavoj Žižek. Based on the same, I argue that the core arguments to these assertions are unpersuasive. I attempt at viewing Human Rights justification in different terms, and, to argue for the legitimacy of Human Rights while abandoning the search for justifications in nature, U.S. Foreign Policy, or Neo-Marxist views. The persistent interpretation problem for quantum mechanics may indicate an unwillingness to consider unpalatable assumptions that could open the way toward progress. With this in mind, I focus on the work of David Bohm, whose earlier work has been more influential than that of his later. As I’ll discuss, I believe two assumptions play a strong role in explaining the disparity: 1) that theories in physics must be grounded in mathematical structure and 2) that consciousness must supervene on material processes. (...) I’ll argue that the first assumption appears to lead us toward Everett’s many worlds interpretation, which suggests a red flag. I’ll also argue that the second assumption is suspect due to the persistent explanatory gap for consciousness. Later, I explore ways that Bohm’s later work holds some promise in providing a better fit with our world, both phenomenologically and empirically. Also, I’ll address the possible problem of realism. John Turri gives an example that he thinks refutes what he takes to be “G. E. Moore's view” that omissive assertions such as “It is raining but I do not believe that it is raining” are “inherently ‘absurd'”. This is that of Ellie, an eliminativist who makes such assertions. Turri thinks that these are perfectly reasonable and not even absurd. Nor does she seem irrational if the sincerity of her assertion requires her to believe its content. A commissive counterpart of (...) Ellie is Di, a dialetheist who asserts or believes that The Russell set includes itself but I believe that it is not the case that the Russell set includes itself. Since any adequate explanation of Moore's paradox must handle commissive assertions and beliefs as well as omissive ones, it must deal with Di as well as engage Ellie. I give such an explanation. I argue that neither Ellie's assertion nor her belief is irrational yet both are absurd. Likewise neither Di's assertion nor her belief is irrational yet in contrast neither is absurd. I conclude that not all Moore-paradoxical assertions or beliefs are irrational and that the syntax of Moore's examples is not sufficient for the absurdity found in them. (shrink)

Judgments about the validity of at least some elementary inferential patterns(say modus ponens) are a priori if anything is. Yet a number of empirical conditions mustin each case be satisfied in order for a particular inference to instantiate this or that inferentialpattern. We may on occasion be entitled to presuppose that such conditions aresatisfied (and the entitlement may even be a priori), yet only experience could tell us thatsuch was indeed the case. Current discussion about a perceived incompatibility betweencontent externalism (...) and first-person authority exemplifies how damaging the neglect ofsuch empirical presuppositions of correct reasoning can be. An externalistic view of mentalcontent is ostensibly incompatible with the assumption that a rational subject should beable to avoid inconsistency no matter what the state of her empirical knowledge may be.That fact, however, needs not be taken (as it often is) as a reductio of externalism: alternatively,we may reject that assumption, adding to the agenda of a philosophical investigationof rationality an examination of the vicissitudes of logical luck. In this paper I pursue an avenue of argument implicit in Patristic thinkers — such as Tertullian and Athanasius — and explicit in the thomistic and scholastic tradition. I argue that there is an ontological unity to the world, and that this unity calls for an explanation in terms of a transcendent cause, traditionally identified with God.

A noção de que a vontade é um bem dado à criatura racional está presente tanto na reflexão de Agostinho como naquela de Anselmo, quando ambos abordam o tema do livre-arbítrio. No entanto, a forma de considerar a vontade difere em cada um deles: para Anselmo, a liberdade será pensada como a reta determinação da vontade para o bem, é o poder de não pecar, expressão da retidão da vontade; já para Agostinho, a vontade livre será pensada como um bem (...) intermediário, que pode aderir ao bem supremo ou afastar-se dele e converter-se para um bem que lhe é próprio, exterior ou inferior. O objetivo deste artigo é apresentar algumas notas de leitura sobre (1) a liberdade da vontade em Agostinho e (2) sobre a definição de liberdade em Anselmo. (shrink)

According to a widespread view, Thomas Kuhn’s model of scientific development would relegate rationality to a second plane, openly flirting with irrationalist positions. The intent of this article is to clarify this aspect of his thinking and refute this common interpretation. I begin by analysing the nature of values in Kuhn’s model and how they are connected to rationality. For Kuhn, a theory is chosen rationally when: i) the evaluation is based on values characteristic of science; ii) a theory is (...) considered better the more it manifests these values; and iii) the scientist chooses the best-evaluated theory. The second part of this article deals with the thesis of the variability of values. According to Kuhn, the examples through which epistemic values are presented vary for each person, and for this reason individuals interpret these criteria differently. Consequently, two scientists, using the same values, can come to a rational disagreement over which theory to choose. Finally, I point out the limitations of this notion of rationality for the explanation of consensus formation, and the corresponding demand for a sociological theory that reconnects individual rationality with convergence of opinions. This research aimed to explain the defense of oral interactions in the presence of information and communication technologies such as WhatsApp (WA) as well as to explore some of the positive contributions of WA used in building the Real Life Communication, especially in the learning environment. By applying the Exploratory design, this research involved 4 participants from various educational backgrounds as a purposively selected data source indicated as WA users at once. Data were collected through Focus Group Discussion, Interview, and (...) Observation and analyzed by several stages i.e. data reduction, displaying data, categorizing, and verifying and concluding. The results showed that oral interactions can decrease both in the language community and learning environment as the dominant use of WA that is not wise. Nevertheless, the use of WA applications also had some positive contributions in building a real relationship. Finally, the assumption that the negative impact of using the WA application should be able to change the mindset and positive attitude of the scholars in initiating and defending an oral interaction in the learning environment. Depuis 2020, le monde a connu une situation sanitaire exceptionnelle à la suite de la pandémie de Covid-19, faisant face à une incertitude dans le monde médical clinique, de la recherche et dans l’ensemble des domaines connexes en santé publique. Le caractère imprévisible et l’absence de données fiables en lien avec ce virus ont fait émerger une quantité d’enjeux éthiques concrets, cela a donc révélé un domaine particulier, la bioéthique, et plus particulièrement une profession, les bioéthiciens. Les « bioéthiciens » (...) se sont fait connaître du grand public en se dressant parfois comme des garde-fous contre des dérives sanitaires, à d’autres moments comme des lanceurs d’alertes face à des injustices naissantes, ou comme critiques, polémistes et parfois même militants dans les médias ou en tant qu’acteurs de première ligne dans les systèmes politico-sanitaires. Ces divers rôles et pratiques illustrent bien la diversité et l’hétérogénéité du domaine de la bioéthique. Toutefois, l’absence de professionnalisation traditionnelle et formelle de la bioéthique complexifie la compréhension de ce champ disciplinaire. Même en Amérique du Nord, où la pratique de la bioéthique est professionnalisée, il ne s’agit toujours pas d’une profession officiellement reconnue et le terme « bioéthicien » lui-même peut être controversé. La forte présence de cette profession durant la pandémie de Covid-19 a révélé l’importance de décrire ce qu’est un bioéthicien, les fonctions qu’il occupe et en quoi consistent ses interventions. Nous apportons cette clarification nécessaire en expliquant la nature de la bioéthique contemporaine dans toute sa diversité. Comme nous l’a démontré la pandémie de Covid-19, les bioéthiciens représentant un soutien et un guide indispensable de nos jours menés par leur esprit critique et leur réflexivité permanente. Russell’s theory of memory as acquaintance with the past seems to square uneasily with his definition of acquaintance as the converse of the relation of presentation of an object to a subject. We show how the two views can be made to cohere under a suitable construal of ‘presentation’, which has the additional appeal of bringing Russell’s theory of memory closer to contemporary views on direct reference and object-dependent thinking than is usually acknowledged. The drawback is that memory as acquaintance (...) with the past falls short of fulfilling Russell’s requirement that knowledge by acquaintance be discriminating knowledge – a shortcoming shared by contemporary externalist accounts of knowledge from memory. This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in criminal (...) law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. This paper discusses “impartiality thought experiments”, i.e., thought experiments that attempt to generate intuitions which are unaffected by personal characteristics such as age, gender or race. We focus on the most prominent impartiality thought experiment, the Veil of Ignorance (VOI), and show that both in its original Rawlsian version and in a more generic version, empirical investigations can be normatively relevant in two ways: First, on the assumption that the VOI is effective and robust, if subjects dominantly favor a certain (...) normative judgment behind the VOI this provides evidence in favor of that judgment; if, on the other hand, they do not dominantly favor a judgment this reduces our justification for it. Second, empirical investigations can also contribute to assessing the effectiveness and robustness of the VOI in the first place, thereby supporting or undermining its applications across the board. This paper presents an investigation about the instant in Heidegger, articulating the analytics of Dasein by Being and Time with the thought of Ereignis. Therefore, it seeks to think, as a presupposition, the existence in his character of temporality. The human being is conceived as Dasein, i. e, in its fundamental relationship to the Being as such. The essence of Dasein is existence. The existence is grounded on Sorge (concern, care), which, in turn, is grounded on temporality. The most own (...) temporality brings together future, past and present in the dynamics of an anticipatory decision on which the man, accepting himself as being-unto-death, it becomes free for their power-to-be authentic, in a response of dedication and self-donation to the call of Being. What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. The Structure of Scientific Revolutions represented a milestone in the attempt to understand scientific development based on empirical observations. However, in the next decades after the publication of his book, history, psychology, and sociology became increasingly marginal in Kuhn’s discussions. In his last articles, Kuhn even suggested that philosophers should pay less attention to empirical data and focus more on “first principles.” The purpose of this article is, first, to describe this radical transformation in Kuhn’s methodological approach, from his initial (...) naturalism to his later and more strict philosophical stance. Next, I present some of the alleged justifications for explaining this transition, such as his interest in problems more firmly attached to the philosophical tradition and a desire for greater acceptance within this community. Although these factors certainly played a role in explaining Kuhn’s change, I also believe that an important theoretical component exerts a fundamental function in this transition: the idea that scientific development is a kind of evolutionary process, which is better understood through the use of abstract theoretical models, instead of sparse observations of scientific activity. In their Why Machines Will Never Rule the World, Landgrebe and Smith (2023) argue that it is impossible for artificial general intelligence (AGI) to succeed, on the grounds that it is impossible to perfectly model or emulate the “complex” “human neurocognitive system”. However, they do not show that it is logically impossible; they only show that it is practically impossible using current mathematical techniques. Nor do they prove that there could not be any other kinds of theories than those in (...) current use. Even if perfect theories were impossible or unlikely, perfection may not be needed and may even be unhelpful. (shrink)

Some "major" evolutionary transitions have been described as transitions in individuality. In this depiction, natural selection might bring about new kinds of individuals, whose evolutionary dynamics takes place in a novel way. Using a categorization proposed by Godfrey-Smith, this transition is fully accomplished when a new "paradigmatic" Darwinian population emerges. In this paper I investigate whether at some point in the evolution in the hominin lineage a transition of this kind might have happened, by assuming some of the theses of (...) dual inheritance theory, especially about the role played by a conformist bias. I argue that Godfrey-Smith misses in his book a scenario in which conformism is one of the preconditions for a transition towards a Darwinian population of cultural groups. (shrink)

Parler de soi plutôt que de moi implique une rupture franche avec les philosophies qui placent le sujet humain en position fondatrice. Le soi est encore moins une « chose » mais un mode d'être ; le soi n'est pas une donnée mais une conquête dont le devenir est en partie indéterminé. C'est donc sous le signe des épreuves qu'il faut penser les variations (...) phénoménologiques et herméneutiques sur le soi. Si la philosophie reste la discipline dominante des réflexions qui parcourent les contributions du volume, l'originalité de cet ouvrage est d'offrir en même temps au lecteur d'autres variations par lesquelles se décline le soi. Cet ouvrage propose une réinterprétation originale du rôle cognitif du Je pense kantien qui se veut pertinente pour la phénoménologie et pour la philosophie actuelle de l’esprit. L’étude du rapport entre temporalité phénoménale et cognition catégoriale constitue le fil conducteur de cette recherche. Elle mène à la question capitale du statut ultime du Moi, du sens du Je du Je pense. Que désigne-t-il : un épiphénomène contingent, une représentation sui generis, une métareprésentation, un acte indéconstructible, un événement fonctionnel, une forme (...) logique ? Recèle-t-il une véritable unité ou plutôt une multiplicité productrice d’unité ? Représente-t-il une identité réelle ou un changement identifiable, un référent vide ou ‘saturé’ ? La réponse à toutes ces questions dépend notamment de la façon de concevoir l’efficacité du Je, c’est-à-dire de l’articulation entre inconscient cognitif, conscience de soi et conscience de quelque chose en général. En pensant Kant avec la philosophie moderne et contemporaine, l’auteur tente d’élucider l’instabilité inévitable du passage critique à un Cogito postmétaphysique. (shrink)

A number of important religious views entail that the ontological and epistemic relations between religion and morality are tighter than most secular thinkers suppose. We will focus on three theistic metaethical accounts of moral phenomena and moral knowledge: natural law theories, divine command theories, and divine will theories. These three types of accounts are among the most dominant in the philosophical literature on theistic ethics in contemporary anglophone philosophy, perhaps owing to their connection to major Western religions such as Christianity, (...) Islam, and Judaism. It is important to note, however, that they hardly exhaust the conceptual space. Intellectual traditions of other religions such as Hinduism, Buddhism, Sikhism, traditional Chinese religions, and African religions raise distinct philosophical questions about and offer a host of alternative views on the relationship between religion and morality (Jeffrey 2019). We close by offering a few such examples, though it is outside the scope of this chapter to provide a comprehensive survey of available views. (shrink)

Este artigo desenvolve uma leitura do livro de Jacques Derrida, Mal de arquivo, com o objetivo de situar o que se poderia chamar de concepção derridiana de arquivo. Ao desdobrar o potencial de conflito que se arquiva na própria palavra "arquivo", Derrida oferece uma concepção de arquivo que, para além das discussões desenvolvidas no livro em questão, abre a possibilidade de uma nova forma de se pensar o âmbito da política. This article develops a reading of Jacques Derrida's book, Archive (...) Fever, with the aim of circumscribing what could be named the Derridian conception of archive. By unfolding the conflictive power which is archived within the proper word "archive", Derrida comes with a conception of archive that, beyond the discussions developed in the book, opens the possibility of a new way of thinking the political. O objetivo deste artigo é analisar os usos que Werner Heisenberg fez da filosofia grega em sua obra. Pretende-se relacionar tais usos não apenas com a argumentação interna presente nos textos do físico alemão, mas também com o contexto histórico, conflitos e debates entre as diversas interpretações da teoria dos quanta durante a primeira metade do século XX. Faremos, inicialmente, uma apresentação geral da teoria quântica e da presença da filosofia na obra de Heisenberg e, em seguida, um estudo de (...) caso da apropriação que Heisenberg fez do pensamento de Leucipo, Demócrito, Heráclito, Platão e Aristóteles.
